Herschell v. Bristol-Myers Squibb

On June 16th, 2015, a widow from New York filed the first Eliquis lawsuit over the death of her 60 year-old husband Donald Herschell. Herschell was admitted to the hospital with serious gastrointestinal bleeding after taking Eliquis for only 3 months. Unfortunately, doctors were unable to stop it since the drug does not have an antidote.

Mrs. Herschell’s claim alleges that the makers of Eliquis improperly marketed the drug as safe without blood tests, didn’t fully disclose the risks, and concealed data during clinical trials that would have given doctors and the FDA more information about its dangers.

Baldwin v. Bristol-Myers Squibb

The second Eliquis lawsuit was filed on July 28th, 2015, by Lester Baldwin, who suffered a serious brain hemorrhage. Baldwin was admitted to the hospital with numbness and loss of feeling in his right hand, which doctors attributed to an intracranial hemorrhage, after taking Eliquis for only a few days. Since there was no antidote to stop the bleeding, his condition worsened for several days even after he discontinued use while the effects of the drug wore off.

Baldwin’s case alleges that Pfizer and BMS concealed the true risks of Eliquis, as well as potentially damaging data from a Chinese study which was used by the FDA to approve the drug in the U.S.

The case is Baldwin v. Bristol-Myers Squibb et al, Southern District of Alabama, Case No.: 1:15-cv-00379 (2015).

Eliquis lawsuits are being filed separately, instead of as a class action. However, these cases will likely be joined in one centralized federal MDL court, which gives the advantages of a class action.

Is there a class action lawsuit?

Every case has its own unique value, and no verdicts or settlements have been paid yet for Eliquis lawsuits. However, similar cases against the drug Pradaxa averaged well into the six-figure range.

What is involved in filing a claim? How long will it take me?

Filing a claim is simple. All that is required is an initial telephone conference to see if you qualify, then your lawyer will order your medical records to begin building a case. The parties will gather additional evidence as they prepare for a mediation conference or trial. All of this can take up to several years, however, there is no cost for you unless you receive compensation.

Eliquis Lawyers

While it is important to speak with a lawyer quickly to preserve your legal rights if you’ve been affected by internal bleeding, choosing the right one can have a significant impact on your case.

Choosing the Right Eliquis Lawyer

First, unlike local personal injury claims, drug injury lawsuits are typically filed in federal courts far away from where you live. In many cases they are consolidated to special federal courts along with thousands of similar lawsuits. Second, these cases are fought against very powerful and well-funded pharmaceutical companies.

Finally, drug injury lawsuits often require a detailed understanding of scientific issues and clinical trials, as well as access to the researchers who perform independent reviews of specific chemical interactions and side effects.

The right Eliquis lawyer should have an intimate understanding of these type of cases, significant experience fighting them in federal MDL courts, and the financial resources to carry your case through years of litigation.

Your lawyer may be located in a different state; however, in most cases, they will come to you, or handle everything for you remotely, so you will not ever have to visit their office or appear in court.
